Can I change my 14 yr old son's last name, without the consent of his mother?

My son has his mother's maiden name. His mother married and changed her last name about 5 yrs ago. My son has a last name that doesn't match his mother or father. My son is 14 yrs old. I recently got custody (joint legal) of my son and now want to change his last name to mine (father's last name). I know she will not consent to his name change. Is it possible to get his name changed without her consent, just serve her with the notice of the court hearing? MI law says that if a child is 14 yrs or older, he can consent to the name change, and he has. We have joint legal custody, no support is paid by either party, she is responsible for 50% of his uninsured medical and she has alternating weekend visitation & holidays. Do you think the courts will grant my petition without her consent?
